Terms of Service

Introduction
These Terms of Service ("Terms") govern your access to and use of the RecapKit website, dashboard, SDK, API, and related services (collectively, the "Service") provided by RecapKit ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
Definitions
- Service — the RecapKit platform, including the website, dashboard, SDK, API, CDN-hosted scripts, and all related tools and documentation.
- User — any individual or entity that accesses or uses the Service.
- Customer Data — any data, content, or information you upload, submit, or transmit to the Service through the dashboard or API, including project configurations, webhook endpoints, and account settings.
- Story Data — the slide content (titles, descriptions, statistics, images, and other media) that you pass to the RecapKit SDK for rendering animated recaps.
Account Terms
- You must be at least 13 years of age to use the Service.
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access.
- One person or legal entity per account. Accounts may not be shared between multiple individuals unless through the team/organization features provided by the Service.
- You are responsible for all activity that occurs under your account.
Use of the Service
Permitted Use
You may use the Service to:
- Integrate the RecapKit SDK into your applications to render animated story recaps for your end users.
- Create and manage recap stories, themes, and schedules through the dashboard.
- Access the API using your issued API keys to programmatically generate recaps.
Prohibited Use
You may not:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or SDK.
- Resell, sublicense, or redistribute the Service or any portion thereof without our prior written consent.
- Abuse, harass, or transmit harmful content through the Service.
- Intentionally overload, disrupt, or interfere with the Service infrastructure.
- Circumvent or attempt to circumvent rate limits, authentication mechanisms, or other security measures.
- Use the Service to build a competing product or service.
API Keys & Access
You are responsible for keeping your API keys secure. Treat API keys as sensitive credentials — do not expose them in client-side code, public repositories, or unsecured environments.
We may revoke or suspend API keys at any time if we detect abuse, excessive usage beyond your plan limits, or violations of these Terms.
Rate limits apply to all API endpoints. Current rate limits are documented in our API documentation and are subject to change. Exceeding rate limits may result in temporary or permanent restriction of access.
Billing & Payment
Paid plans are billed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your selected billing cycle).
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
Plan Limits
Each plan includes specific resource limits:
- Free — 1 project, 2 team members, 50 recaps/month.
- Starter ($25/mo or $20/mo billed annually) — 5 projects, 10 team members, 250 recaps/month.
- Growth ($69/mo or $55/mo billed annually) — 15 projects, 50 team members, 1,000 recaps/month.
- Scale ($125/mo or $100/mo billed annually) — unlimited projects, team members, and recaps.
- Enterprise (custom pricing) — unlimited resources with custom terms and dedicated support.
If you exceed your plan's limits, we may restrict access to certain features until you upgrade to a higher plan or the next billing cycle begins.
Cancellation & Downgrades
You may cancel your subscription at any time through the dashboard. Upon cancellation, your plan remains active until the end of the current billing period. Downgrades take effect at the start of the next billing cycle. We do not provide prorated refunds for unused time on canceled plans.
Intellectual Property
The Service, including its source code, SDK, documentation, design, and branding, is owned by RecapKit and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
You retain full ownership of your Customer Data and Story Data. By using the Service, you grant us a limited, non-exclusive, worldwide license to process, store, and transmit your data solely as necessary to provide and improve the Service.
Customer Data
You are solely responsible for the data you pass through the SDK and the Service. You represent and warrant that you have all necessary rights, consents, and permissions to use and transmit any content included in your Story Data and Customer Data.
You must not submit data that infringes on third-party intellectual property rights, contains illegal content, or violates the privacy rights of any individual.
We process your data in accordance with our Privacy Policy.
Availability & Support
The Service is provided "as is" and "as available." We strive to maintain high availability but do not guarantee a specific uptime percentage unless you are on an Enterprise plan with a separate Service Level Agreement (SLA).
We may perform scheduled maintenance, deploy updates, or experience unplanned outages. We will make reasonable efforts to notify you of planned downtime in advance.

Limitation of Liability
To the maximum extent permitted by law, RecapKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
Termination
Either party may terminate this agreement at any time. You may terminate by canceling your subscription and ceasing use of the Service.
We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the security or integrity of the Service.
Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy, typically within 30 days of account closure.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction within the United States.
